Whistleblower Claim FAQ

Answers from Our Chicago Employment Lawyer

What is a whistleblower claim? - Federal, state, and local laws encourage anyone with personal knowledge of corrupt or illegal practices within a company to report it. Reporting illegal or fraudulent actions is a protected activity, and the law prohibits employers from retaliating against employees for doing so.

Why should I file a whistleblower claim? - If your claim is successful, the court may order your employer to reinstate you and award you back pay and benefits, compensatory damages and reasonable attorney's fees. Beyond recovering compensation, you will have the satisfaction of knowing that you have secured justice for yourself and others like you.

What is Sarbanes-Oxley? - Sarbanes-Oxley is a law passed by Congress in 2002 in response to major corporate accounting scandals, which had a devastating effect on the securities markets. Among other things, it provides enhanced protection against whistleblower retaliation.

What is a qui tam lawsuit? - Qui tam "is part of a Latin phrase that refers to the right of a citizen to sue on behalf of the government. If you have personal knowledge that your employer is attempting to defraud the government, you can file a qui tam lawsuit on behalf of the government, and you may be entitled to a percentage of any damages recovered."

Do you represent both employees and employers? - Fern has practiced employment law since 1983. Since 1992, the Law Offices of Fern Trevino has exclusively represented Chicago-area executives and employees, and has refused all requests to represent employers.
