Gender/Sex Discrimination: An Illegal Practice

Employers are forbidden from making decisions regarding hiring, promotion, demotion, termination, compensation, job training, or other terms and conditions of employment based on an employee's sex or gender. This means that employers are forbidden from treating some employees less favorably than others based on their gender. Additionally, employers are forbidden from creating or even tolerating a hostile work environment based on an employee's gender.

Sex-based discrimination is prohibited by federal law (Title VII of the Civil Rights Act of 1964; the Pregnancy Discrimination Act; and the Equal Pay Act), state law (the Illinois Human Rights Act) and local ordinances. The Pregnancy Discrimination Act prohibits discrimination on the basis of pregnancy, childbirth, and related conditions. The Equal Pay Act prohibits pay discrimination on the basis of sex for employees performing work requiring substantially equal skill, effort, and responsibility that is performed under similar working conditions. Other forms of sex discrimination can include sexual harassment and sexual orientation discrimination.
