Often associated with gender and sex discrimination, pregnancy discrimination occurs when an employer makes decisions about hiring, disciplining, promoting, compensating or terminating an employee based on pregnancy. An employer who discriminates against pregnant employees and employees who are trying to get pregnant is violating the law.

The Pregnancy Discrimination Act

The Pregnancy Discrimination Act amended Title VII of the Civil Rights Act of 1964 and offers the following protections:

  • Pregnancy Discrimination in Hiring: A pregnant woman cannot be refused employment simply because of her pregnancy or a pregnancy-related condition.
  • Maternity Leave and Pregnancy: If a pregnant employee is unable to perform certain duties of her job as a result of her pregnancy, her employer may be required to take reasonable measures to accommodate her condition, just as the employer would take measures to accommodate any other person with a temporary disability. For example, if the employer allows unpaid medical leave for someone who has suffered a heart attack, this leave must also be granted to a pregnant employee. The employer must also provide the same benefits (if any) to pregnant employees that the employer provides to other non-pregnant employees who are temporarily disabled and on leave.
  • Health Insurance: If an employer provides health insurance, pregnancy-related conditions must be covered on the same basis as other medical conditions.
  • Employer Retaliation: An employer may not retaliate against an employee for reporting or threatening to report pregnancy discrimination. Some forms of retaliation may include demotion, pay reduction, transfer to a less desirable shift or position and termination.
