A "whistleblower" is a person who reports illegal or improper conduct by a company, government agency or other organization, to the public or to a person in authority. It is illegal for an employer to retaliate against a whistleblower by terminating or otherwise mistreating the employee. Whistleblower claims arise when employees are fired or otherwise retaliated against for engaging in certain "protected activities," that is, activities protected by law or public policy.

Examples of protected activities include:

  • (A) - reporting or threatening to report a workplace injury - or fraud, such as double billing, health care fraud, insurance fraud, overcharging, or other improprieties that affect the health, safety or welfare of Illinois citizens.
  • (B) - refusing to participate in such wrong-doing. 
  • (C) - The law prohibits retaliation against employees who report, threaten to report, or refuse to participate in certain types of illegal or improper conduct, such as those that threaten the health, safety or welfare of Illinois citizens. Statutes (laws passed by Congress) and the common law (law that arises from court decisions) provide distinct remedies for whistleblowers and are subject to distinct statutes of limitation.
